We review the Certificate of Title, Deposited Plan, and Section 88B instruments to identify registered easements, rights of way, covenants, and restrictions. We visit the site to check for visible encroachments - neighboring structures, fences, or gardens that cross the boundary. This is important because under the Limitation Act 1969, long-term encroachments can lead to adverse possession claims. We also identify potential planning constraints such as heritage listings, flood zones, bushfire zones, and contaminated land registers. For development-minded buyers, we assess likely subdivision potential based on lot size, zoning, and existing easements. We note building setback requirements under the relevant LEP and likely development yield. The report includes scaled plans showing easement locations, approximate boundary positions (based on fences and title dimensions), and key development constraints. This gives buyers and their solicitors the information needed to assess whether the property suits their needs - before exchange, when you can still walk away.
